Uma Thurman expecting her third child

Uma Thurman backstage at the Tommy Hilfiger show during Fashion Week in New York on Feb. 12.

By Kurt Schlosser

Uma Thurman is expecting her third child, People reports.

The mag says a rep confirms that the actress, 41, is pregnant with her first child with?financier Arpad Busson. Thurman has two children -- daughter Maya, 13, and son Levon, 10?-- with ex-husband Ethan Hawke.

People reports that Thurman and Busson, 49, began dating in 2007 and survived a brief split in 2009.

Life & Style magazine quotes a friend of the actress, who says, "She hasn't announced it yet, but a lot of her friends were asking her because they could tell the difference when they saw her at New York Fashion Week. She's usually so skinny, but now she has the cutest little bump and a glow about her."

Life & Style says Thurman "kept covered up" in the front row at the Tommy Hilfiger show on Feb. 12, wearing a baggy blouse and loose blazer.

Oscars 2012: How 'The Artist' Got To The Academy Awards

Buzz for the Oscar favorite began back at the 2011 Cannes film festival, and it's been raking in award nominations ever since.

In a day and age where it seems as if everything and everyone in Hollywood is consumed by the latest and greatest cutting-edge technology, the fact that a black-and-white silent film set in the late 1920s/ early 1930s is dominating the Oscar conversation at the moment is surprising, to say the least.

"The Artist" is a legitimate silent film — there is no dialogue! — that revolves around the relationship between George Valentin (Best Actor nominee Jean Dujardin), a matinee idol in Hollywood before the dawn of talkies, and aspiring actress Peppy Miller (Best Supporting Actress nominee Bérénice Bejo). Its tone is nostalgic, sweet, romantic and fun, and the film has become a formidable force to be reckoned with on the road to Oscar gold.

Buzz for "The Artist" began back in May 2011 at the Cannes film festival, where the film premiered and Dujardin took home the Best Actor award. From then on, the well-received crowd-pleaser went on to wow critics and audiences alike on the festival circuit, including the Toronto International Film Festival, Telluride Film Festival, the San Sebastian International Film Festival and the Santa Barbara International Film Festival.

Once awards season kicked into high gear, the film started raking in multiple nominations and dominating a variety of best-of lists compiled by the major critics' groups. So far, the French independent film has picked up four Critics' Choice Awards, top prize at the Directors Guild Awards and Producers Guild Awards, three Golden Globes, the Best Actor SAG award for Dujardin, seven BAFTAs (the U.K.'s Oscar equivalent), and on Friday, six César Awards (the French equivalent of the Oscars). Not to mention the film's five Independent Spirit Awards nominations and 10 Academy Awards nominations, where it is poised to take home most, if not all, of the evening's major awards.

The MTV Movies team has the 2012 Oscars covered! Stick with us for everything you need to know leading up to the awards show, and on Sunday, February 26, tune in to MTV.com at 5 p.m. ET for our two-and-a-half-hour red-carpet live stream and updates on the night's big winners. Bird flu, pig flu, now bat flu? Human risk unclear

(AP Photo/Centers for Disease Control and Prevention, Amy Gilbert)

(AP) ? For the first time, scientists have found evidence of flu in bats, reporting a never-before-seen virus whose risk to humans is unclear.

The surprising discovery of genetic fragments of a flu virus is the first well-documented report of it in the winged mammals. So far, scientists haven't been able to grow it, and it's not clear if ? or how well ? it spreads.

Flu bugs are common in humans, birds and pigs and have even been seen in dogs, horses, seals and whales, among others. About five years ago, Russian virologists claimed finding flu in bats, but they never offered evidence.

"Most people are fairly convinced we had already discovered flu in all the possible" animals, said Ruben Donis, a Centers for Disease Control and Prevention scientist who co-authored the new study.

Scientists suspect that some bats caught flu centuries ago and that the virus mutated within the bat population into this new variety. Scientists haven't even been able to grow the new virus in chicken eggs or in human cell culture, as they do with more conventional flu strains.

But it still could pose a threat to humans. For example, if it mingled with more common forms of influenza, it could swap genes and mutate into something more dangerous, a scenario at the heart of the global flu epidemic movie "Contagion."

The research was posted online Monday in the journal Proceedings of the National Academy of Sciences.

The CDC has an international outpost in Guatemala, and that's where researchers collected more than 300 bats in 2009 and 2010. The research was mainly focused on rabies, but the scientists also checked specimens for other germs and stumbled upon the new virus. It was in the intestines of little yellow-shouldered bats, said Donis, a veterinarian by training.

These bats eat fruit and insects but don't bite people. Yet it's possible they could leave the virus on produce and a human could get infected by taking a bite.

It's conceivable some people were infected with the virus in the past. Now that scientists know what it looks like, they are looking for it in other bats as well as humans and other animals, said Donis, who heads the Molecular Virology and Vaccines Branch in the CDC's flu division.

At least one expert said CDC researchers need to do more to establish they've actually found a flu virus.

Technically, what the CDC officials found was genetic material of a flu virus. They used a lab technique to find genes for the virus and amplify it.

All they found was a segment of genetic material, said Richard "Mick" Fulton, a bird disease researcher at Michigan State University.

What they should do is draw blood from more bats, try to infect other bats and take other steps to establish that the virus is spreading among the animals, he continued. "In my mind, if you can't grow the virus, how do you know that the virus is there?"

Donis said work is going on to try to infect healthy bats, but noted there are other viruses that were discovered by genetic sequencing but are hard to grow in a lab, including hepatitis C.

U.S. boosting military presence in Strait of Hormuz to fend off any ...

By Madison Ruppert

Editor of End the Lie

The Western military hardware in the Persian Gulf region (Image credit: RIA Novosti)

The Western military buildup in the Persian Gulf region has been quite long and sizeable. I have been doing my best to keep track of it and record it for my readers through my series ?Iran: a quickly evolving geopolitical imbroglio? and many companion articles outside of that series.

It is now ramping up even more with the Wall Street Journal reporting that the United States is planning to beef up their so-called defenses in the region even more.

They report that the U.S. is increasing defenses based on both land and sea in the Persian Gulf and notified Congress of plans to acquire new mine-detection and clearing equipment.

They also are looking to expand their surveillance capabilities in and around the Strait of Hormuz according to anonymous defense officials who were familiar with the requests, one of which was already submitted earlier this month.

The military is also reportedly looking to rapidly modify their ship-based weapons systems in order to optimize their efficacy against Iranian fast-attack boats and shore-launched cruise missiles which were tested in a previous Iranian military exercise.

While Iran has repeatedly threatened to close the Strait of Hormuz in response to international sanctions over their nuclear program, I do not think that they are stupid enough to ignore the massive American presence in the region ? which is only going to increase.

Western nations have been unrelenting in their claims that Iran is pursuing nuclear weapons, even though it is contradicted by the majority of the American intelligence community.

Meanwhile, Iran has been consistent in their vehement denial of any such activities and their claims are backed up by the facts ? as evidenced by the opinion of intelligence analysts ? while the claims made by Western nations are backed up by nothing but belief and rhetoric.

Iran has also been taking some steps to prepare for a possible Western strike with exercises being held just days ago which focused on defending nuclear sites from a possible attack.

Russian Information Agency Novosti (RIA Novosti) rightly points out, ?There has been increasing speculation in recent weeks that Israel may carry out a military strike on Iran?s nuclear sites. The United States has also refused to rule out force.?

Indeed all signs point towards Israel and the United States gearing up for war and there is substantial evidence showing that Israeli intelligence has already been carrying out covert operations in Iran for some time, which has actually been confirmed by unnamed American officials.

However, Iran hasn?t done the best job of putting Western fears (as unfounded as they may be) to rest by hinting at a possible pre-emptive attack.

Recently Mohammad Hejazi, a senior Iranian military commander, said, ?Our strategy now is that if we feel our enemies want to endanger Iran?s national interests, and want to decide to do that, we will act without waiting for their actions,? according to Reuters.

Then again, you can?t really blame Iran for attempting to give the international community the impression that they are unafraid of a Western assault and would actually go as far as to take the first shot.

However, in reality I do not think that the Iranian leadership would be willing to watch their entire nation get bombed into the Stone Age unless they had a really good reason to.

I suspect that Iran is just trying to puff up its proverbial chest in order to intimidate and avoid an actual conflict. I think that the Iranian military and politicians are well aware of the fact that the United States, in concert with Israel, Britain and France, could absolutely eviscerate much of their country.

Say what you will about Iranian President Mahmoud Ahmadinejad but one thing he does not appear to be is ignorant and imbecilic. It would take someone who fully embodied both of those things to willingly put themselves in the crosshairs of the West with a green light to use any and all force they deem necessary.

I see Iran attempting to hold on to whatever legitimacy they can for as long as humanly possible and a pre-emptive attack would likely sever what few ties they still have and cause them to lose what little support they have.

This is especially true as the United States just continues to build up military assets in the region, further showing just how brutal the destruction could be.

SC Workers' Compensation ? Guaranty Fund ? What Happens If ...

This recent SC Court of Appeals case discusses what happens if the employer and/or workers? compensation insurance carrier go out of business. This case seems particularly relevant in the current economic downturn that has been ongoing for several years now. Fortunately, in South Carolina, we have the Guaranty Fund which protects injured workers and their families if this contingency occurs. Thank goodness our legislature has taken this step for our State. Now, if a carrier does not survive, injured workers can still access funds to pay their medical bills and claims. In this case, even after the claimaint died prematurely from an unrelated illness, her family was still ultimately compensated from this Fund. Worker?s compensation cases are already difficult but having to proceed with litigation after a carrier fails is even more complex and anxiety producing. Better make sure your attorney knows what to do if this happens in your case. There is simply too much at stake for you and your family to risk having an inexperienced attorney.

At Reeves, Aiken & Hightower LLP, our lawyers are experienced workers? compensation attorneys. ?Robert J. Reeves is a former intensive care unit Registered Nurse (RN) who has actually treated patients with the same type of serious injuries he now represents in workers? compensation cases. ?Both Robert J. Reeves and Arthur K. Aiken are former insurance defense attorneys who know what to anticipate and how to prepare for trial and insurance company tactics. ?During our twenty-two (22) years each of practicing law, we have handled virtually every type of workers? compensation injury, including neck, back, shoulder, knee accidents, closed head / brain injury, herniated disks, bulging disks, diskectomy surgery, fusion procedures, arthroscopy, automobile accidents on the job, psychological / post traumatic stress, permanent and total disability claims, and wrongful death. Appeal From Lancaster County

AFFIRMED IN PART AND REVERSED IN PART

E. Ros Huff, Jr., of Irmo, for Appellants Lancaster Convalescent Center and Legion Insurance Company, and Mark D. Cauthen and Peter P. Leventis, both of Columbia, for Appellant South Carolina Property and Casualty Insurance Guaranty Association.

Andrew Nathan Safran and Pope D. Johnson, both of Columbia, and Ann McCrowey Mickle, of Rock Hill, for Respondents.

LOCKEMY, J.:? In this workers? compensation action, Lancaster Convalescent Center (Employer) and Legion Insurance Company (Legion), in liquidation through South Carolina Property and Casualty Insurance Guaranty Association (the Guaranty Association), appeal the circuit court?s decision affirming the decision of the Appellate Panel of the Workers? Compensation Commission (Appellate Panel) to award Frances S. Hudson certain workers? compensation benefits.? We affirm in part and reverse in part.?? ?

FACTS

This appeal comes to this court after several workers? compensation hearings.? In 1997, Frances S. Hudson sustained an injury to her left leg while in the course and scope of her employment with Employer for which she received workers? compensation benefits.? Later, in an order dated October 3, 2001, the single commissioner found Hudson permanently and totally disabled based on a combination of injuries stemming from her original 1997 work-related injury.? Due to the combination of her injuries, the single commissioner found Hudson unable to perform any kind of work.

Thereafter, Hudson requested a lump-sum payment of her disability award, but Employer and Legion objected.? After a hearing on the matter, the single commissioner found it was in Hudson?s best interests to receive the lump-sum payment of her previous award.? The single commissioner noted that the South Carolina Code vests authority in the Workers? Compensation Commission to determine, with discretion, whether a lump-sum payment is in an employee?s best interest.? During the pendency of the lump-sum workers? compensation proceedings, Hudson died from cancer on June 30, 2002.

Employer and Legion appealed the single commissioner?s ruling to the Appellate Panel and argued it was error to award Hudson the lump-sum award.? Thereafter, the Appellate Panel affirmed all of the single commissioner?s findings of facts and conclusions of law, sustaining his order in its entirety.? On July 28, 2003, Legion became insolvent.? Accordingly, after the ruling regarding the lump-sum payment was rendered, the circuit court stayed the appeal due to Legion?s insolvency.? During the stay, the Guaranty Association assumed all rights, duties, and obligations of Legion as the insolvent insurance carrier pursuant to section 38-31-60 of the South Carolina Code (Supp. 2009).? Thereafter, Employer and the Guaranty Association appealed the Appellate Panel?s order to the circuit court and argued it was error to award the lump-sum award, and the Appellate Panel?s order must be vacated in light of Hudson?s untimely death.

The Honorable Paul E. Short, then a circuit court judge, affirmed the Appellate Panel?s order in its entirety by written order.? The circuit court found substantial evidence supported the Appellate Panel?s lump-sum award and that the award was not inconsistent with section 42-9-301 of the South Carolina Code (1985).? Concerning whether Hudson?s death impacted the workers? compensation proceedings, the circuit court found this issue was not preserved for review.? Additionally, the circuit court found Employer and Legion?s assertion regarding the abatement of Hudson?s claim was unpersuasive.? Employer and the Guaranty Association appealed the circuit court?s decision to this court, but they subsequently withdrew the appeal.? Consequently, our clerk of court signed an order of dismissal and remittitur on April 20, 2004.

At some point during the proceedings, Employer and the Guaranty Association learned of Hudson?s death and ceased making payments.? In response, Kenneth and Keith Hudson, as executors of their mother?s estate (the Estate), requested payment of the lump-sum award.? The Hudson sons raised the issue on behalf of Matthew and Andrew Deese, Hudson?s dependent grandchildren.? Specifically, the Estate argued the grandchildren were entitled to payment of the lump sum, as Hudson?s dependents.? Employer and the Guaranty Association argued Hudson?s lump-sum payment abated upon her death and maintained they were not obliged to pay any sum.? The single commissioner found Judge Short?s 2004 order, which addressed Hudson?s lump-sum award, could not be challenged or relitigated.? Specifically, the single commissioner found: (1) Hudson?s disability award could reasonably fall within section 42-9-10 of the South Carolina Code (Supp. 2009); (2) all of the current beneficiaries had colorable claims to the lump-sum proceeds; and (3) the Guaranty Association failed to establish abatement under section 42-9-280 of the South Carolina Code (1985).? Further, the single commissioner ordered the Guaranty Association to pay the lump sum with interest and a ten percent penalty within seven days of the order.

Again, Employer and the Guaranty Association appealed the single commissioner?s order.? On appeal, the Appellate Panel affirmed all of the single commissioner?s factual findings and legal conclusions with the exception of the ten percent penalty imposed.? Specifically, the Appellate Panel noted the Guaranty Association did not pursue a frivolous defense.? Thereafter, the Estate and the Guaranty Association cross-appealed to the circuit court.? The Honorable Kenneth Goode issued an order affirming the Appellate Panel with the exception of the ten percent penalty it vacated.? In his order, Judge Goode concluded section 42-9-90 of the South Carolina Code (1985) compelled a penalty; accordingly, he reinstated the penalty.? This appeal followed.

STANDARD OF REVIEW

?The Administrative Procedures Act establishes the standard of review for decisions by the South Carolina Workers? Compensation Commission.??Forrest v. A.S. Price Mech., 373 S.C. 303, 306, 644 S.E.2d 784, 785 (Ct. App. 2007). ??In workers? compensation cases, the [Appellate Panel] is the ultimate fact finder.? ?Shealy v. Aiken County, 341 S.C. 448, 455, 535 S.E.2d 438, 442 (2000). ?This court reviews facts based on the substantial evidence standard. ?Thompson v. S.C. Steel Erectors, 369 S.C. 606, 612, 632 S.E.2d 874, 877 (Ct. App. 2006). ?Under the substantial evidence standard, the appellate court may not substitute its judgment for that of the Appellate Panel as to the weight of the evidence on questions of fact. ?Forrest, 373 S.C. at 306, 644 S.E.2d at 785;?see also?S.C. Code ? 1-23-380(5) (Supp. 2009). ?The appellate court may reverse or modify the Appellate Panel?s decision only if the claimant?s substantial rights have been prejudiced because the decision is affected by an error of law or is clearly erroneous in view of the reliable, probative, and substantial evidence on the whole record. ?Forrest, 373 S.C. at 306, 644 S.E.2d at 785-86.? ?Substantial evidence is not a mere scintilla of evidence nor evidence viewed from one side, but such evidence, when the whole record is considered, as would allow reasonable minds to reach the conclusion the [Appellate Panel] reached.? ?Shealy, 341 S.C. at 455, 535 S.E.2d at 442.

LAW/ANALYSIS

I.??Abatement

Employer and the Guaranty Association argue the circuit court erred in affirming the Appellate Panel?s decision finding Hudson?s lump-sum award survived her death.? However, Judge Short?s order found this issue was not properly before the circuit court in 2004 because Employer and the Guaranty Association failed to raise it to the Appellate Panel after Hudson died.? Employer and the Guaranty Association appealed Judge Short?s ruling but later withdrew the appeal.? Thus, we find Judge Short?s ruling finding the abatement issue unpreserved is the law of the case.??See?Judy v. Martin, 381 S.C. 455, 458, 674 S.E.2d 151, 153 (2009) (?Appellant may not seek relief from the prior unappealed order of the circuit court because the order has become the law of the case.? Under the law-of-the-case doctrine, a party is precluded from relitigating, after an appeal, matters that were either not raised on appeal, but should have been, or raised on appeal, but expressly rejected by the appellate court.?).? Accordingly, we decline to address the issue on the merits.

II.??Beneficiaries/Next of Kin Dependents

Employer argues the circuit court erred in failing to address whether all four beneficiaries have legitimate claims.? The Guaranty Association argues the circuit court erred in affirming the Appellate Panel?s decision to award Hudson?s lump sum to her Estate rather than to her beneficiaries pursuant to section 42-9-280 of the South Carolina Code (1985).? In response, the Estate argues Employer and the Guaranty Association acknowledged and accepted the beneficiaries? valid and reasonable settlement of their respective claims to the lump-sum proceeds. ?Thus, based on this stipulation, the Estate argues Employer and the Guaranty Association cannot now contest the manner in which the lump-sum award will be distributed.? We agree with Employer and the Guaranty Association.

We disagree with the Estate?s assertion that Employer and the Guaranty Association acknowledged and accepted the beneficiaries? valid and reasonable settlement of their respective entitlements to the lump-sum proceeds.? On the contrary, during the hearing before the single commissioner on January 25, 2005, Employer?s counsel consistently questioned to whom the lump-sum award should go and the manner of the payment.? We note there was a discussion among the parties during which they agreed to divide the award evenly between Hudson?s sons and minor grandsons.? The single commissioner noted Employer?s counsel had no objection to the manner in which the funds were split but reserved the right to claim that the funds were payable.? However, we do not find such a stipulation by Employer?s counsel on the record and note he stated:? ?our position is the [E]state takes nothing.?? Thereafter, Employer and the Guaranty Association appealed the single commissioner?s decision to award Hudson?s lump sum to her Estate, rather than to her beneficiaries, to both the Appellate Panel and the circuit court.? Therefore, we find this issue is properly preserved for our review and do not find Employer stipulated to the manner of dividing the lump-sum award.? Accordingly, we will address this issue on the merits.

Pursuant to section 42-9-280:

When an employee receives or is entitled to compensation under this Title for an injury covered by the second paragraph of ? 42-9-10 or 42-9-30 and dies from any other cause than the injury for which he was entitled to compensation, payment of the unpaid balance of compensation?shall be made to his next of kin dependent upon him for support, in lieu of the compensation the employee would have been entitled to had he lived. (emphasis added)

Here, Hudson?s cause of death, cancer, was unrelated to her work injury.? Pursuant to section 42-9-280, the workers? compensation commission must pay the unpaid balance of her lump-sum award to her dependent grandchildren rather than to her sons as beneficiaries of the Estate.? Therefore, we find the circuit court erred in affirming the Appellate Panel?s decision to award Hudson?s lump sum to the Estate rather than to her beneficiaries pursuant to section 42-9-280 of the South Carolina Code (1985).? Accordingly, we reverse that portion of the circuit court?s order and direct all lump-sum payments to be paid directly to Hudson?s dependent grandsons.

III.???Interest Award

Next, Employer and the Guaranty Association argue the circuit court erred in affirming the Appellate Panel?s decision to award Hudson?s Estate interest on the lump-sum award. ?Specifically, the Guaranty Association maintains section 38-31-20(8)(h) (Supp. 2009) of the South Carolina Property and Casualty Insurance Guaranty Association Act disallows claims for interest.? Section 38-31-20(8) provides:

?Covered claim? means an unpaid claim, including one of unearned premiums, which arises out of and is within the coverage and is subject to the applicable limits of an insurance policy to which this chapter applies issued by an insurer, if the insurer is an insolvent insurer and (a) the claimant or insured is a resident of this State at the time of the insured event, if for entities other than an individual, the residence of a claimant or insured is the state in which its principal place of business is located at the time of the insured event or (b) the claim is for first-party benefits for damage to property permanently located in this State.??Covered claim? does not include: . . . (h) any claims for interest.? (emphasis added)

In response, the Estate points to section 38-31-60 of the South Carolina Code (1985 & Supp. 2009) which reveals broad duties owed by the Guaranty Association.? We agree with Employer and the Guaranty Association on this issue.

Section 38-31-60(b) states that the Guaranty Association ?is considered the insurer to the extent of its obligation?on the covered claims?and, to this extent, has all rights, duties, and obligations of the insolvent insurer as if the insurer had not become insolvent.? ?As we already indicated, interest is not covered.? Accordingly, based on the plain reading of the statute, we reverse the circuit court?s order affirming the Appellate Panel?s decision to award interest.

IV.??Penalty Imposed

Finally, Employer and the Guaranty Association argue the circuit court erred in reversing the Appellate Panel?s decision not to award Hudson?s Estate a ten percent penalty.? Originally, the single commissioner imposed a ten percent penalty under section 42-9-90 of the South Carolina Code (Supp. 2009) based on Employer and the Guaranty Association?s frivolous defense.? Thereafter, the Appellate Panel reversed the penalty after finding Employer and the Guaranty Association did not pursue a frivolous defense.? Finally, the circuit court reinstated the penalty and relied on?Martin v. Rapid Plumbing, 369 S.C. 278, 631 S.E.2d 547 (Ct. App. 2006).? The Estate argues?Martin?is inapplicable to the facts of their case, and therefore, the circuit court erred by reinstating the ten-percent penalty.[1]

In response, the Estate maintains the circuit court properly found that the ten percent penalty pursuant to section 42-9-90 was mandatory.? Their reasoning is that Judge Short?s order was final and should not have been relitigated.? Further, the Estate maintains that under section 42-9-90, an employer or carrier must prove that circumstances beyond their control prevented payment of all compensation owed.? Also, the Estate maintains this section does not afford the Commission any discretion when deciding whether to impose a penalty.? We agree with the Estate.

Section 42-9-90 provides:

If any installment of compensation payable in accordance with the terms of an agreement approved by the Commission without an award is not paid within fourteen days after it becomes due, as provided in ? 42-9-230, or if any installment of compensation payable in accordance with the terms of an award by the Commission is not paid within fourteen days after it becomes due, as provided in ????? 42-9-240, there shall be added to such unpaid installment an amount equal to ten per cent thereof, which shall be paid at the same time as, but in addition to, such installment, unless such nonpayment is excused by the Commission after a showing by the employer that owing to conditions over which he had no control such installment could not be paid within the period prescribed for the payment.

Here, Employer and the Guaranty Association simply stopped paying compensation to the Estate.? We agree that they had a non-frivolous defense, as the Appellate Panel found.? However, as the single commissioner and Judge Goode found, the imposition of the penalty is mandatory under the statute.? Therefore, we affirm the circuit court?s reinstatement of the ten-percent penalty.

CONCLUSION

Judge Short?s ruling finding the abatement issue unpreserved is the law of the case.? Therefore, we decline to address this issue on the merits.? Pursuant to section 42-9-280 of the South Carolina Code, we reverse the portion of Judge Goode?s order affirming the Appellate Panel?s decision to pay Hudson?s remaining lump sum balance to her sons as beneficiaries and order the balance be paid to her grandsons as beneficiaries.? Finally, based on applicable statutes, we reverse the interest award and affirm the ten-percent penalty imposed.? Accordingly, the decision of the circuit court is

AFFIRMED IN PART AND REVERSED IN PART.

22 guests from Carnival Splendor cruise robbed in Mexico

Twenty-two guests of the Carnival Splendor were robbed in Mexico last week while on a trip to see a nature trail after landing in Puerto Vallarta, the cruise line said.

Valuables, passports and other identification were taken from the guests during the Thursday port call. "There were no injuries and all guests returned safely to the ship," the cruise line said in a statement.

The tourists were part of a weeklong cruise that left the Port of Long Beach on Feb. 19 and returned?Sunday morning, Carnival spokesman Vance Gulliksen said.

The cruise line has suspended the guided nature trail tour where the robbery occurred. "Carnival is working with guests to reimburse them for lost valuables and assist with lost passports or other forms of identification," the cruise line said.

"Carnival sincerely apologizes to its guests for this very unfortunate and disturbing event and is providing its full support and assistance," the Miami-based company said.

The Carnival Splendor ship generally carries more than 3,000 passengers, and operates year-round weeklong cruises from Long Beach.

In 2010, the Carnival Splendor lost power after an engine fire, leaving its passengers to spend four days aboard a dark, cold ship; passengers were served spam and hot dog salad after the electricity failed.

As of last fall, only one cruise line had decided to suspend stops in Puerto Vallarta, a popular port of call. That decision was made by Santa Clarita-based Princess Cruises, which is owned by Carnival Cruise Lines.

Carnival itself did not cancel stops on its namesake cruise line in Puerto Vallarta, and Princess Cruises was set to resume visits to Puerto Vallarta this month.

A port just north of Puerto Vallarta has received far more skepticism by cruise lines. After a February 2011 shooting left two dead in a parking lot of a hotel in the tourist area of the city of Mazatlan, several cruise lines began canceling stops, including Carnival Cruise Lines. Gulliksen said Carnival's cancellation of visits to Mazatlan remains in effect.

"We are working with local officials as the investigation continues and we do not have any itinerary changes as it relates to Puerto Vallarta at this time," Gulliksen said.

Tools for Success in Retail Business: Retail Inventories

February 24th, 2012 by admin

The success of running a retail business lies at the ability of the managers to develop a solid and effective Retail Inventory. Retail businesses that are located in areas with expected seasonal climactic situations such as flood or heavy snow fall are not able to supply their goods to their consumers on time. In this case, an inventory management system can be of great aid in helping business owners meet the demands of their respective target market needs. Maintaining huge stocks of products may cause a problem if the stock is not sold or shipped within the expected time, the idea is not advisable. Stocking perishable items such as dairy products, fruits and the likes can prove to be a complete loss if the products are left unsold for a long period of time.

(AP) ? Oil prices are approaching last year's highs as tensions increase over Iran's nuclear program. The rise pushed gasoline prices on Friday to a national average of $3.65 per gallon, the highest ever for this time of year.

Western nations fear Iran is building a nuclear weapon and have been trying to force it to open its facilities to inspection. Iran has refused, turning away international inspectors this week for the second time this month. The United Nations said Friday that Iran has responded to the recent scrutiny by speeding up production of higher-grade enriched uranium, feeding concerns that it is developing a bomb.

As both sides dig in for a protracted standoff, investors are snapping up oil contracts in case fighting breaks out in the heart of the one of the world's biggest oil-producing regions. "Everyone's pricing in the potential for war now," independent analyst Stephen Schork said. "Without a concrete resolution, nobody knows how high this can go."

Israel hasn't ruled out an attack on Iran, and Iran has said it is ready to strike pre-emptively, possibly targeting the Strait of Hormuz, if it is threatened. The Persian Gulf passageway is a potential choke point for oil supplies. One-fifth of the world's oil tankers pass through it every day.

On Friday benchmark West Texas Intermediate crude rose by $1.94 to end the week at $109.77 per barrel in New York. Brent crude rose by $1.85 to finish at $125.47 per barrel in London.

WTI peaked near $114 a barrel last May, while Brent rose above $126 per barrel.

The price of gasoline, which is made from crude oil, has soared with oil prices. The national average jumped by nearly 12 cents per gallon in a week, with state averages above $4 per gallon in California, Alaska and Hawaii.

It looks like they'll keep climbing.

Tom Kloza, publisher and chief oil analyst at Oil Price Information Service, said pump prices will add at least another 10 to 15 cents per gallon in coming days to reflect a recent jump in wholesale markets.

At $3.65 per gallon, gasoline is still below last year's high of $3.98 and the record $4.11 set in 2008. Kloza says pump prices are on pace to top both of those in coming months. He thinks gasoline will climb as high as $4.25 per gallon by late April.

The rise will weigh on the economy, pushing leisure and business travel costs higher. Every one-cent increase in the price of gasoline costs the economy $1.4 billon, analysts say.

Prices have been surging particularly on the West Coast where a BP refinery was shut down after a fire. That refinery in Blaine, Wash., is the third-largest on the West Coast with a production capacity of 230,000 barrels per day.

The closure comes at a tough time for the refining industry. Most refiners are already slowing production to get ready for a switch over from winter to more expensive summer fuel blends. The seasonal switch usually creates a temporary dip in supplies that pushes prices higher at this time of year. The loss of the BP refinery could make that dip even deeper.

Gasoline has become a major political issue this year as prices tick higher.

Some lawmakers have called on the Obama administration to release more oil from emergency stockpiles in the Strategic Petroleum Reserve, but analysts say that would be ineffective. The government tried that last summer after the Libyan uprising shut down that country's oil fields. Prices dipped slightly but eventually rebounded.

Independent oil analyst Andrew Lipow pointed out that the U.S. has adequate oil supplies right now, and a release of reserves wouldn't make much sense. Traders are mostly concerned with how the Iran situation will affect supplies this summer. Nobody's sure what will happen, Lipow said, and that is pushing investors to buy more oil as an insurance policy against a major conflict.

"It's just unclear how this plays out," Lipow said. "The worry is that Iran will be forced into a position that they try to impact their neighbors in some way" and curtail oil production in the entire region.

In other energy trading, heating oil rose by 2 cents to finish at $3.32 per gallon, while gasoline futures rose by 4 cents to end at $3.15 per gallon. Natural gas prices fell by 7 cents to finish the week at $2.55 per 1,000 cubic feet.

New calculations boost carbon released from thawing permafrost
Changes in permafrost as it thaws could release more carbon into the atmosphere than scientists had suspected, new research suggests. When permanently frozen ground thaws, it deepens the ?active layer? of soil from which carbon can percolate, Charles Koven of the Lawrence Berkeley National Laboratory in California reported February 19. Under pessimistic scenarios in which greenhouse gases continue to rise, some 60 to 80 percent of permafrost could disappear by 2100, he said. Calculations of how soil types vary by depth suggest that up to 700 petagrams (700 billion metric tons) of carbon could be vulnerable to decomposition. ?Typically people haven?t thought of the depth distribution of soil carbon, but that?s critical,? Koven said. ?Alexandra Witze

Lab-grown meat ready to eat this year, scientists say
A hamburger made from meat grown in the lab might be ready to eat this October, Mark Post from Maastricht University in the Netherlands reported on February 19. So far, scientists using bovine stem cells have made pieces of skeletal muscle that are about 3 centimeters long. Citing the growing global demand for meat and the environmental costs of raising livestock, Post said ?we need to get alternatives.? Post ? who received ?250,000 (about U.S. $331,000) from an anonymous donor for this project ? thinks that with adequate funding, lab-grown meat products could be commercially available in?10 to 20 years. ?Rebecca Cheung

Watch Jennifer Aniston's boyfriend breakdance

By Gina Serpe, E! Online

Moves like Jagger? You can keep 'em. We much prefer the moves like Justin!

Justin Theroux dropped by the "Ellen DeGeneres Show" this week and fittingly enough, considering where he was, quickly took to talking up his breakdancing abilities -- particularly that his girlfriend, Jennifer Aniston ("I don't know if any of you guys know her," he joked), is "literally obsessed" with it.

Well, you can see where this is headed.

MORE: Jennifer talks about her " topless" and--yikes--"bottomless" role in Wanderlust!

"I have a very particular pair of shoes which I breakdance in," he explained. "[Jennifer] just recently celebrated a birthday and ever since she saw 'Zoolander' she's been obsessed with making me breakdance. Literally obsessed with it. I breakdanced at a friends' wedding. So she's been saying, 'When are you going to breakdance?' "

Which is when he decided to create a brilliant (but not foolproof, as he'd soon find out) stall tactic.

PHOTOS: Fashion Spotlight: Jennifer Aniston

"That's when I sort of invented this thing. 'Well, I have my 'breaking shoes' and if I don't have my 'breaking shoes' then I don't break-dance, sort of full stop.' We got home that night, it was late, and she literally came out with a pair of shoes. My actual breaking shoes."

And wouldn't you know it? She happily sent them over to Ellen's studio, and the host even more happily handed them over to Justin. Luckily for all of us, he obliged.

A Checklist for Purchasing Kitchen Appliances ... - kitchen remodeling

DishwasherChoosing appliances can be an exciting way to update your kitchen, but it can also be a struggle to decide which kitchen appliances to purchase. Many retail stores and websites have a wide variety when it comes to dishwashers, ovens, ranges and refrigerators, making it hard to narrow down your selection and choose just one. Use this checklist as you consider each individual appliance.

Is It In My Budget?

This is the most important question to ask yourself. If the price is too high and won?t fit in your budget, ski it entirely and move to the next item. There are so many different prices for appliances that it is always possible to find something that falls into your price bracket.

Will It Create a Cohesive Look?

This is especially important if you already have some of the key features planned or purchased in the kitchen. For example, if you like the look of the stainless steel oven but all your other appliances are white, it won?t match in the space.

Is It Energy Efficient?

Along with being better for the environment, energy efficient appliances will save you money each month on your energy bills.

By considering these three important factors you can narrow down your options and pick the best kitchen appliances for your own home.

When you need home appliances and kitchen remodeling accessories of all types, DirectBuy has a wide selection for you to choose from. You can purchase virtually everything you need for home improvement without paying retail markup.

Implantable, wireless sensors share secrets of healing tissues

ScienceDaily (Feb. 21, 2012) ? A new implantable sensor developed at Rensselaer Polytechnic Institute can wirelessly transmit data from the site of a recent orthopedic surgery. Inexpensive to make and highly reliable, this new sensor holds the promise of more accurate, more cost-effective, and less invasive post-surgery monitoring and diagnosis.

Following an orthopedic procedure, surgeons usually rely on X-rays or MRIs to monitor the progress of their patient's recovery. The new sensors, created by Rensselaer faculty researcher Eric Ledet, would instead give surgeons detailed, real-time information from the actual surgery site. This in vivo data could lead to more accurate assessments of a patient's recovery, or provide better insight into potential complications.

The wireless sensor measures only 4 millimeters in diameter and 500 microns thick. It needs no battery, no external power, and requires no electronics within the body. Instead, the sensor is powered by the external device used to capture the sensor data.

"Our new sensor will give surgeons the opportunity to make personalized, highly detailed, and very objective diagnoses for individual patients," said Ledet, assistant professor in the Department of Biomedical Engineering at Rensselaer. "The simplicity of the sensor is its greatest strength. The sensor is inexpensive to produce, requires no external power source, yet it is robust and durable. We are very excited about the potential of this new technology."

The sensors look like small coils of wire and are attached to commonly used orthopedic musculoskeletal implants such as rods, plates, or prostheses. Once implanted in the in vivo environment, the sensor can monitor and transmit data about the load, strain, pressure, or temperature of the healing surgery site. The sensor is scalable, tunable, and easy to configure so that it may be incorporated into many different types of implantable orthopedic devices.

One key benefit of this new technology is the possibility of more accurate assessments by physicians for when recovering patients are able to return to work without a risk of further injury.

"Having a stream of real-time in vivo data should take some of the approximation and subjectivity out of declaring a patient recovered and ready to return to work," Ledet said.

Ledet and his research team have filed for patent protection for their new sensor. They currently make each sensor by hand, but are investigating methods for mass production. Ledet has been working on this sensor technology for about five years, and has presented his progress at several conferences. His most recent presentation was earlier this month in San Francisco at the Orthopaedic Research Society (ORS) 2012 Annual Meeting.

Ledet, who earned his master's and doctoral degrees from Rensselaer in 1995 and 2003, conducted this research in collaboration with colleagues at Albany Medical College. Ledet's co-investigator on this project is Dr. Richard Uhl, who earned his bachelor's degree from Rensselaer and is head of the Division of Orthopedic Surgery at Albany Medical College.
