Filing: Gov doesn't want challenge to surveillance

(AP) ? Lawyers for a U.S. citizen charged with terrorism in Chicago said Friday in a filing that the government is purposely dodging questions about whether it used expanded secret surveillance programs against their client in a calculated bid to ensure the hotly debated practices can't be challenged in the Supreme Court.

The claim came in an early morning filing at federal court in Chicago by attorneys for Adel Daoud. The 19-year-old, of Hillsdale, is accused of trying to ignite what he thought was a car bomb outside a bar last year in Chicago. Daoud, whose trial is set for Feb. 3, has pleaded not guilty to attempting to use a weapon of mass destruction and other charges.

In their own filing last week, federal prosecutors refused to say whether they used far-reaching surveillance programs to launch their two-year investigation of the suburban teenager, saying they were under no legal obligation to spell out just what led to an FBI sting focused on Daoud.

Recent leaks by a former National Security Agency contractor, Edward Snowden, revealed that a secret Foreign Intelligence Surveillance Court, or FISA court, authorized one program that gathers U.S. phone records and another that tracks the use of U.S.-based Internet servers by foreigners with possible links terrorism.

Friday's 13-page defense filing argues the government's refusal to confirm or deny whether it used those programs left defense attorneys legally hamstrung: With no answer, they have no grounds to mount a challenge to the programs' constitutionality, and yet prosecutors could still use the evidence at trial.

"Whenever it is good for the government to brag about its success, it speaks loudly and publicly (about its surveillance methods)," the filing says. "When a criminal defendant's constitutional rights are at stake, however, it quickly and unequivocally clams up under the guise of state secrets."

A message seeking comment was left early Friday with the U.S. Attorney's Office in Chicago. Federal prosecutors typically do not comment on pending cases.

U.S. District Judge Sharon Johnson Coleman, who is overseeing Daoud's case, has said she will hear oral arguments soon on the dispute. She could order government attorneys to state clearly if they used the expanded surveillance or she could agree with prosecutors that they are under no obligation to do so.

The main point of contention in Daoud's case, as in much of the national debate over U.S. surveillance, is the secret FISA court ? set up by the 1978 Foreign Intelligence Surveillance Act.

FISA amendments adopted by Congress in 2008 allow the government to obtain broad intercept orders from the court ? raising the prospect that calls and emails between foreign targets and innocent Americans could also be subject to surveillance.

In February, the Supreme Court voted 5-4 to throw out an attempt by U.S. citizens to challenge the 2008 expansion of FISA on grounds they could not prove the government will monitor their conversations along with those of potential foreign terrorist and intelligence targets.

But the high court added that its decision did not insulate the FISA expansion from judicial review, and it suggested a couple of ways a challenge could be brought, including a scenario in which an American lawyer did get swept up in FISA monitoring.

Prosecutors have said the investigation of Daoud began in 2011 when the FBI detected he was active on extremist Internet forums and sites in which he inquired about killing Americans. By 2012, undercover agents posing as terrorists had engaged Daoud in email conversations, telling him they would help him stage an attack. On Sept. 14, 2012, Daoud allegedly drove a Jeep Cherokee to the Chicago bar with what he thought was a bomb inside. After he pushed a mock triggering device, FBI agents moved in and arrested him.

They're both sons of New Jersey, they've both been called bosses, and both and have a shared connection with "The Sopranos," so it shouldn't come as a huge surprise that Bruce Springsteen dedicated part of his Thursday night show in Coventry, U.K., to the late James Gandolfini, who died Wednesday in Rome.

Still, it was a generous gesture.

According to Glide Magazine's "Hidden Track" column, Springsteen paused 12 songs into his set to announce that the band would play 1975's "Born to Run" album all the way through, dedicating it to Gandolfini.

A regular member of Springsteen's E Street band, Steven Van Zandt, appeared as Tony Soprano's consigliere on the series for its full 6-season run, as Silvio Dante, and wrote on his Facebook page Wednesday, "I have lost a brother and a best friend. The world has lost one of the greatest actors of all time."

Meanwhile, Springsteen wasn't the only Tri-state institution to offer up a tribute to Gandolfini; the New York Yankees observed a moment of silence for the actor and sports fan ahead of the start of their Wednesday night game against the Tampa Bay Rays.

As noted in The Hollywood Reporter, the Yankees played the "Sopranos" theme song, then displayed a 2002 photo of Gandolfini waving in the stadium along with the silence. Gandolfini had thrown out the opening pitch at that game, and read from Lou Gehrig's 1939 farewell speech. (Sports fans have noted that Gandolfini died on what would have been Gehrig's 110th birthday.)

Additionally, "Sesame Street" posted a clip from Gandolfini's 2002 appearance on the show, where he comforted Muppet Zoe about being afraid.

"I know what it's like to be scared," he said on the show. "Everyone gets scared sometimes."

The partners haven't said just what new tricks they'll demonstrate, if any, but it's clear that there won't be a size penalty when the concept is as slim as the laptops in stores today. Synaptics and Tobii plan to tour the PC throughout the industry during the summer and the fall, and they're no doubt hoping that a few vendors use the concept as inspiration.

Solitary mutation destroys key 'window' of brain development

June 21, 2013 ? Scientists from the Florida campus of The Scripps Research Institute (TSRI) have shown in animal models that brain damage caused by the loss of a single copy of a gene during very early childhood development can cause a lifetime of behavioral and intellectual problems.

The study, published this week in the Journal of Neuroscience, sheds new light on the early development of neural circuits in the cortex, the part of the brain responsible for functions such as sensory perception, planning and decision-making.

The research also pinpoints the mechanism responsible for the disruption of what are known as "windows of plasticity" that contribute to the refinement of the neural connections that broadly shape brain development and the maturing of perception, language, and cognitive abilities.

The key to normal development of these abilities is that the neural connections in the brain cortex -- the synapses -- mature at the right time.

In an earlier study, the team, led by TSRI Associate Professor Gavin Rumbaugh, found that in mice missing a single copy of the vital gene, certain synapses develop prematurely within the first few weeks after birth. This accelerated maturation dramatically expands the process known as "excitability" -- how often brain cells fire -- in the hippocampus, a part of the brain critical for memory. The delicate balance between excitability and inhibition is especially critical during early developmental periods. However, it remained a mystery how early maturation of brain circuits could lead to lifelong cognitive and behavioral problems.

The current study shows in mice that the interruption of the synapse-regulating gene known as SYNGAP1 -- which can cause a devastating form of intellectual disability and increase the risk for developing autism in humans -- induces early functional maturation of neural connections in two areas of the cortex. The influence of this disruption is widespread throughout the developing brain and appears to degrade the duration of these critical windows of plasticity.

"In this study, we were able to directly connect early maturation of synapses to the loss of an important plasticity window in the cortex," Rumbaugh said. "Early maturation of synapses appears to make the brain less plastic at critical times in development. Children with these mutations appear to have brains that were built incorrectly from the ground up."

The accelerated maturation also appeared to occur surprisingly early in the developing cortex. That, Rumbaugh added, would correspond to the first two years of a child's life, when the brain is expanding rapidly. "Our goal now is to figure out a way to prevent the damage caused by SYNGAP1 mutations. We would be more likely to help that child if we could intervene very early on -- before the mutation has done its damage," he said.
